US Republicans urge return of homophobic legislation

A group of Republican politicians have urged California Governor Arnold Schwarzenegger to appeal against a federal judge's ruling that struck down the state's same-sex marriage ban.

Twenty-seven members of the state assembly's Republican caucus sent Gov Schwarzenegger a letter insisting that it was up to him to defend the rights of voters who passed the homophobic Proposition 8 almost two years ago.

Chief US District Judge Vaughn Walker overturned the measure as unconstitutional last month.

The state has until September 11 to challenge Judge Walker's ruling in the 9th US Circuit Court of Appeals.

Gov Schwarzenegger and Attorney General Jerry Brown, who both refused to support Proposition 8 in Judge Walker's court, have said they do not plan to appeal against the ruling.

But the conservative coalition that sponsored the ban is determined to continue appealing against the ruling.
